Plagiarism case over Leona Lewis' 'Collide' single heads to London court

Even before it has gone on sale, Leona Lewis' "Collide" single has become controversial because a Swedish DJ named Avicii is claiming that "Collide" plagiarizes a song that he wrote. On August 8, 2011, the High Court in London will hear Avicii's plea to place an injunction against "Collide" and to prevent the song from going on sale. The song was set to be released on September 4, 2011.

"Collide" is the first single from the still-untitled third album from Lewis, the winner of "The X Factor" U.K. in 2006.

"Collide" had its world premiere on Scott Mills' BBC One Radio show on July 15, 2011. The song was written by Autumn Rowe, whose credits include Alexis Jordan's "Happiness" and "The X Factor" U.K. 2010 finalist Cher Lloyd's "Swagger Jagger." "Collide" (whose U.K. release date is September 4, 2011) was produced by Sandy Vee, whose credits include Rihanna's "Only Girl (In the World)," David Guetta's "Where Them Girls At," Jordan's "Good Girl" and "The X Factor" U.S. judge Nicole Scherzinger's "Wet."

The dance tune "Collide" is a departure from the anthemic ballads that made Lewis famous. As previously reported, the public's reactions to the song have been mixed, based on Internet comments.

Avicii (whose real name is Tim Bergling) claims that the instrumental of "Collide" plagiarizes his song "Fade Into Darkness," which he says that he recorded in October 2010. Avicii says that Lewis' record company (Syco Music) asked him for permission to use "Fade Into Darkness," but he says that he turned down the request. Avicii has since been signed to the independent label Ministry of Sound. He claims that "Collide" is a "re-recording" of "Fade Into Darkness."

Syco/Sony Music and Lewis' management have declined to comment on the case.
